Thank you for choosing our services. These General Terms and Conditions (hereinafter referred to as 'GTC') apply to the services provided and orders placed through the website operated by mYields Ltd. at the domain www.mydentification.com and its subdomains (hereinafter referred to as 'mYdentification Website'). They outline the general terms and conditions, including the rights and obligations of the user, and the rules applicable to all users visiting the mYdentification Website. As part of our service packages and support services available on the mYdentification Website, we provide NFC digital business cards.
The services available on the mYdentification Website are provided by mYields Limited Liability Company(registered office: 7214, Várong, Főmajor 02 7 hrsz., company registration number: 01-09-372629), registered with the Metropolitan Court of Registration, represented by: Dora Szakalos, tax number: 28756288-2-43 (hereinafter referred to as 'we' or 'mYields' or 'our company').

These Terms and Conditions fully regulate the rights and obligations of mYields and you in relation to the use of the mYdentification Website and our services.
1. Acceptance of the General terms of Service (GTC)

By visiting the mYdentification Website, all users declare that they have read, understood, accepted, and acknowledged the provisions of these Terms and Conditions as binding upon them.

mYields provides the mYdentification Website and services on the condition that you (i) comply with all the terms and conditions set forth in these Terms and Conditions, and (ii) meet all relevant technical requirements and product/service descriptions published on the mYdentification Website in relation to the use of our services, excluding any other widely known and regularly applied practices by similar contract parties in the industry. By registering on the mYdentification Website or placing an order, you declare that you have read, understood, accepted, and acknowledged the provisions of these Terms and Conditions and the Privacy Policy as binding upon you.

We do not submit to the provisions of the code of conduct under Act XLVII of 2008 on the prohibition of unfair commercial practices against consumers.
2. User statements

By registering on the mYdentification Website or placing an order, you declare and warrant that:

you will comply with the applicable laws while using the mYdentification Website and Services

3. Modification of General Terms and Conditions

This current Terms and Conditions is valid for an indefinite period, effective from the date of entry into force until amended or revoked.

We reserve the right to unilaterally modify, suspend, or permanently discontinue these Terms and Conditions and the services provided through the mYdentification Website at any time, as well as to change or delete the content of the mYdentification Website at any time without prior notice. We reserve the right to modify or discontinue the mYdentification Website, in whole or in part, temporarily or permanently, or to restrict access to the mYdentification Website in any geographic area or jurisdiction at any time.

In the event of any modification to the Terms and Conditions, the modified version will always be displayed on the mYdentification Website. The modification becomes effective simultaneously with its publication on the mYdentification Website and does not affect the rights previously acquired by the parties. If you continue to use the mYdentification Website after the modification, it means you accept the modified Terms and Conditions.
4. mYdentification products

On the mYdentification Website, it is possible to order NFC-enabled business cards. For each order, we provide the customer with 2 plastic NFC business cards.

Our products and related services are available with detailed descriptions on the mYdentification Website under the 'Our Cards' menu (hereinafter referred to as 'Products'). The product description appears when you click on the selected Product. If you need more information about any Product than what is provided on the website, please contact us at the above-mentioned contact details. Please note that plastic cards should not be stored in direct sunlight as they may discolor. In all other physical characteristics, they are equivalent to any plastic card (e.g., bank card) and should be handled accordingly.

Individual order:

We offer digital business cards to users with either a custom design created by the user or a pre-designed look.

When ordering the Product, we create both the physical plastic card and the digital business card. The person using the card can transfer the digital business card to their business associate's or partner's phone with a single touch using the NFC chip. The recipient's phone can immediately save the transferred digital business card as a contact. Please note that the chip on the plastic card only works with phones that have an NFC reader.

The digital business card contains all the information provided by the customer, such as name, company name, contact details, website, and social media profiles.

Additionally, the card can be linked to the customer's website and other profiles using a QR code. The URL is created by the customer, and mYields provides the digital business card in .vcf format in such a way that it links to the URL assigned to the card. For customers who do not have a website but wish to use the .vcf business card link, we offer a personalized webpage service within the mYdentification Website for one year free of charge after the business card is created. If the customer wishes to continue using the webpage service after the one-year period, a separate agreement is required. For details, please contact info@myields.com."

Business Package:
-
We offer a Business Package for companies considering larger orders with their own branding, which the customer designs and forwards to mYields.

We will create 2 plastic NFC business cards per person for the client, for which the client will provide the design to mYields.

When ordering the product, we will create the physical plastic card itself, which will be printed with the design provided by the client. Additionally, we will create the digital business card, which the user can transfer to their business partner's phone with a single tap using the NFC chip embedded in the card. The recipient's phone can immediately save the transferred digital business card as a contact. Please note that the chip on the plastic card only works with phones equipped with an NFC reader.

The digital business card will include all the information provided by the client, such as name, company name, contact details, website, and social media profiles.

In addition, the card can be linked to the client's website and other profiles using a QR code. The URL will be created by the client, and mYields will provide the digital business card in .vcf format, linking it to the URL assigned to the card.

5. Obligations of the customer

You are (i) obliged to provide us with all necessary data, information (including creative materials, photos requested by you for the fulfillment of the order), or other statements required for the proper fulfillment of the order at your own expense, (ii) obliged to fulfill all other obligations specified in these Terms and Conditions within the deadline (any delay cannot be attributed to mYields, thus particularly, but not exclusively, it cannot be considered as a faulty, delayed, or non-fulfillment of the contract), and (iii) obliged to ensure that your devices and systems meet the requirements specified in the product descriptions.

If you provide us with the creative materials and photos necessary for the fulfillment of the order, you declare and warrant that the creative materials you provide do not violate applicable laws or the personal rights of third parties (including data protection and moral rights or trademark protection), and that no third party has any rights that would limit or prevent their use by us in any way. In the event of any proceedings initiated by any authority, court, or any other third party due to such creative materials, you are directly liable and obliged to indemnify our company.
6. Creating a User Account

On the mYdentification website, users have the option to create a user account. Registration of a user account is not required to place an order on the website. However, we recommend creating an account as it facilitates future orders. In their account, users can also record additional information to simplify future orders, such as saving a shipping address and phone number. This way, users do not need to re-enter this information when placing a specific order, thereby speeding up the ordering process. Additionally, users can view their order history in their account.

To register a user account, go to the 'Login' section and fill out the registration form, or use your Facebook or Google account.

During registration, the following information is required: email address and password. After providing this information, the user must consent to the processing of their data and accept all provisions in the Privacy Policy and these Terms and Conditions by checking the relevant boxes. The registration request can be submitted by clicking the 'Register' button. After submitting the registration request, an email will be sent to the user's email address with a confirmation link. By clicking this link, the registration can be finalized. A confirmation email will be sent to the user's email address to confirm the successful registration.

The user can initiate the deletion of their user account at any time by sending a request via email to info@myields.com.

We reserve the right to reject the registration request if the user provides false or incomplete information on the registration form, or if the information or circumstances suggest that the purpose of the registration is not the proper use of the mYdentification website. We also reserve the right to delete the registration if we detect any misuse or illegal behavior by the user while using the mYdentification website (browsing or ordering).

The user is solely responsible for the accuracy, currency, and truthfulness of the information provided during the creation of the user account and when placing an order. mYields disclaims all liability arising from incorrect, erroneous, or false information provided on the mYdentification website. The user may only provide their own personal data on the mYdentification website.

Using the User Account:

The user can log into their account at any time using the email address and password provided during registration.

The user agrees to keep the information recorded in their account accurate and up to date at all times. After logging in, the user can modify the information recorded in their account. Changes to the information do not affect the data recorded in orders that have already been submitted. If you have any further requests or questions regarding data modification, please contact us.

mYields is not liable for any damages arising from the user forgetting their password or it becoming accessible to unauthorized persons for reasons not attributable to mYields.

We ensure the security of login information (especially the password) as described in our Privacy Policy. The user is solely responsible for maintaining the confidentiality of their account and password. Please ensure that you do not leave the system unattended after logging in and log out after using the site. Note that closing the browser does not automatically log you out of the site. The user is responsible for all activities that occur under their user account. If you have reason to believe that your account is no longer secure, please notify us immediately at
7. Order process

Placing a Custom Order:

The customer can place their order through the mYdentification Website (webshop). Registration is not required to place an order.

The list of available Products can be found on the mYdentification Website under the 'Our Cards' menu. To place an order for a Basic NFC Business Card, the customer needs to click the 'Add to Cart' button located next to the Product, then select what they want to display on the business card and the desired quantity from the options that appear in the pop-up window, and then click the 'Add to Cart' button. For ordering a pre-designed business card, the customer can add the Product to their Shopping Cart by clicking the 'Add to Cart' button next to the Product and then selecting the desired quantity from the pop-up sidebar.

After the customer has selected the Product and added it to the Shopping Cart, a window will appear on the right side of the screen, informing the customer that the Product has been added to the Shopping Cart. The customer can continue shopping and add more Products to the Shopping Cart by closing this information window on the right side, clicking anywhere outside the window, or by entering their cart by clicking the 'Shopping Cart Contents'

If the customer chooses to continue shopping, they can reopen the Shopping Cart contents at any time and proceed with placing the order by selecting the shopping cart icon in the upper right corner and then clicking the 'Shopping Cart Contents' button. In the Shopping Cart, the order summary with the total amount payable can be viewed. The selection process can be interrupted at any time, and the products placed in the Shopping Cart can be deleted by clicking the 'X' button next to the Product, or the desired quantity can be modified. For Basic NFC Business Cards, if the customer wants to modify the previously selected properties of the Product, they need to delete the Product from the Shopping Cart and then add it again. If the customer has a coupon code, it should be entered in the relevant field on this page and then click the 'Apply' button.

After the customer finalizes the contents of the Shopping Cart, by clicking the 'Checkout' button, the system will direct them to the next page where all the necessary information for the order must be provided (shipping address, billing address, payment method). All fields marked with '•' are mandatory and the order cannot be placed without providing this information. By clicking the 'Continue' button, the customer can proceed to the payment page.

In the 'Place Order' section, the customer can see the order summary and verify the accuracy of the information they have provided, as well as the contents of the Shopping Cart. If they wish to make changes to the order or the information, they can do so by clicking the 'Edit Cart' button.

After verifying the information and the contents of the cart, the customer must declare that they accept all the provisions written in these Terms and Conditions, as well as the Privacy Policy, by ticking the relevant checkboxes before placing the order. Then, by clicking the 'Place Order' button and paying the purchase price according to the selected payment method, the customer can place the order. For credit card payments, we redirect to the payment service provider's payment page. The order can be interrupted at any time before pressing the 'Place Order' button without any consequences. There is no minimum order amount.

Submitting the order as described above constitutes an offer, which creates a payment obligation for the customer. However, this does not automatically mean that we accept the order and the contract is concluded. mYields will only accept the order if the customer has provided all the necessary information during the order process and has accepted the Terms and Conditions and the Privacy Policy documents.

Within 48 hours after submitting the order, we will send a confirmation email with the order details and the advance invoice to the email address provided in the order. The contract for the purchase of the Product is concluded upon confirmation of the order by mYields (when the confirmation email becomes available in the customer's email system). If the confirmation is not received by the customer within this period, the customer's offer commitment and any obligations automatically cease without any further conditions, and the customer is not bound by the order and is not obliged to accept the Product. mYields excludes liability in all cases where the confirmation is not received on time because the customer provided an incorrect email address or other incorrect information during the order process, or due to the storage capacity of the customer's mailbox being full and unable to receive messages.

If we need additional information to fulfill the order (including creative materials, photos provided by the user), we will notify the customer by email within 48 hours after the order is submitted.

The concluded contract does not qualify as a written contract, it is not registered, and therefore it is not accessible afterwards. The conclusion of the contract is evidenced by the electronically saved order data and the issued invoice, which mYields retains for the period specified by accounting and tax laws. The contract between the parties is concluded in Hungarian.

1. Placing a Business Order: The customer can place their order via email at the following email address: info@myields.com. When ordering a Business Package, a unique Service Agreement will be concluded, and the fulfillment of the order will be governed by the provisions of this Service Agreement.
2. You are solely responsible for the accuracy, currency, and truthfulness of the data provided during the order process. mYields excludes all liability arising from incorrect, erroneous, or false data provided on the mYdentification Website. You may only provide your own personal data on the mYdentification Website.
3. After the purchase price has been paid, the order cannot be modified. If you wish to modify the details of your order after it has been submitted (but before payment), please contact us.
4. Both businesses and consumers can place orders from within the European Union. Only businesses can place orders from outside the European Union.
8. Payment terms

The current prices are displayed on the mYdentification Website. The price indicated for each Product is the purchase price of the given Product, which includes value-added tax.

We reserve the right to change prices. Any price change will take effect simultaneously with its appearance on the mYdentification Website and will not apply to orders already placed. Therefore, you will always pay the price you see on the site at the time of ordering.

The purchase price must be paid using one of the payment methods authorized on the mYdentification Website for all orders placed from the mYdentification Website:

Online card payment: In the case of online card payment, after sending the order, the system redirects the customer to our financial service provider's (Stripe Technology Europe, Limited) online payment interface, where the payment is made. The data provided here is seen and managed exclusively by the financial service provider; the card details provided by the customer do not appear in and are not stored in the mYields system. The financial service provider only notifies mYields of the successful payment. The financial service provider (Stripe Technology Europe, Limited) operates based on the licenses available at the following link: https://stripe.com/spc/licenses. mYields is not responsible for any errors that may occur on the financial service provider's payment page.

Payment by bank transfer: If you choose bank transfer, the purchase price must be transferred to the bank account number of mYields Kft. (IBAN: LT453250097433596437; BIC: REVOLT21), which will be indicated on the proforma invoice. Payment is due within 8 days from the date of the proforma invoice.

The purchase price is considered paid when the amount has been credited to our bank account. If the purchase price is not paid within the deadline, we are entitled to withdraw from the contract.

All costs related to the payment of the purchase price - e.g., transaction fees, conversion and banking costs - are borne by you.

In the event that we are unable to provide the service for any reason not attributable to you after the purchase price has been paid, we will notify you immediately and refund the full amount you paid.
9. Delivery conditions

The ordered Products will be delivered by post to the delivery address specified in the order. The Products will be delivered within 3 (three) weeks after the confirmation of the order.

Delivery to a delivery address within the territory of Hungary is free of charge. In case of delivery to a delivery address outside Hungary, the delivery fee will be indicated on the website before placing the order.
10. Right of withdrawal

This Section 10. applies if you place an order on the mYdentification website as a Consumer. A consumer is defined as a natural person acting outside the scope of their profession, independent business, or commercial activity.

When ordering products available on the mYdentification Website, the customer cannot exercise their right of withdrawal, in view of point c) of paragraph (1) of Section 29od Government Decree 45/2014 (II.26)on the detailed rules of contracts between consumers and businesses, as the ordered Products are considered goods that are clearly tailored to the customer's personal needs within the framework of the service provided by mYields.
11. Supplier's warranty, product warranty

The information on the statutory obligations regarding warranty for supplies and product warranty is included in Annex 1 of these General Terms and Conditions (GTC).
12. Warranty

mYields guarantees that the Product will comply with the technical functions specified in point 4 and on the mYdentification Website for 1 year from the date of delivery to the customer. mYields' warranty obligation is limited to correcting deviations from these technical functions (i.e., malfunction or non-functioning of the chip or QR code on the business card). mYields will correct these defects free of charge for the customer during the warranty period, based on a written defect notification sent by the customer to mYields.

mYields will address the defect correction considering the following:

mYields is obliged to correct the defect, at its discretion, either by replacement, support, or modification necessary to ensure proper functioning;
-
In the event of a defect occurring during the warranty period, mYields will respond in writing to the written notification received from the customer and indicate the expected duration of the correction;
-
mYields will correct defects reported during the warranty period even after the warranty period has expired;
-
The warranty period will restart for the replaced (repaired) part and for any defect resulting from the correction.

The fulfillment of mYields' warranty obligations is subject to the following conditions being met by the customer:

The customer uses the plastic cards provided by mYields as intended;

The customer must immediately notify mYields in writing of any malfunction. The date of the defect notification shall be considered the date of the malfunction.

The warranty does not cover any defect, malfunction, or damage caused by any modification, alteration, or repair carried out by the customer without prior written approval from mYields.
13. Data protection

In its data processing activities, mYields complies with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council (General Data Protection Regulation, 'GDPR') and other applicable data protection laws. We handle personal data confidentially and exclusively in accordance with our Privacy Policy. Our Privacy Policy can be found on the mYields (mYdentification) Website. 14. Intellectual property

The entire content of the mYdentification Website and all its elements, including any textual, visual, and other content, as well as the visual and technical solutions related to the organization and selection of these contents, graphics, trademarks, logos, and other parts, are protected by intellectual property rights, and mYields is the exclusive holder of these rights.

mYields grants a preliminary, non-exclusive, and non-transferable license to download, store, and print the content available on the mYdentification Website in its original form for personal use only. This license does not permit making the content available to third parties in any form. This usage license only allows for the handling and archiving of a single original copy of the content found on the mYdentification Website. Beyond this, the user does not acquire any other rights or licenses related to mYields' copyrights, trademarks, or any other intellectual property rights associated with the mYdentification Website.

The commercial use of any content on the mYdentification Website, whether online or via any digital or analog data carrier, including particularly its distribution or sale in any form, is strictly prohibited. It is also forbidden to alter, modify, or incorporate any part of the website into any other work, publication, or website, whether in electronic or other forms.

Any further use of the content on the mYdentification Website or other intellectual property of mYields is only possible with the prior permission of mYields. mYields will take all civil and criminal legal actions to terminate and remedy any procedures that infringe on the intellectual property rights described in this section.

mYields is entitled to use the customer's trademark, logo, name, and other intellectual property provided by the customer to the extent necessary for the fulfillment of the order, and to grant permission for such use to third parties (especially subcontractors). The customer declares that there are no legal obstacles to the use of the copyrighted works, trademark-protected items, or other intellectual property provided to mYields for the fulfillment of the order, meaning that no third party has any rights that would hinder or prevent the intended use of these intellectual creations.
15. Complaint handling

This section 15 applies if you place an order on the mYdentification Website as a consumer.

We will investigate and respond to your written complaint within 30 days, either via the email address or postal address you provided.

We will investigate verbal complaints immediately and, if possible, resolve them on the spot. If you do not agree with the handling of the complaint or if it is not possible to investigate the complaint immediately, we will promptly record the complaint and our position on it in writing, and respond to the complaint within 30 days via the email address or postal address you provided.

We make every effort to resolve any disputes through negotiation. If it is not possible to settle the legal dispute through negotiation, you may turn to the conciliation body of your place of residence or stay for the simple, quick, out-of-court resolution of the consumer dispute. In the absence of a domestic residence or stay, the conciliation body of our company's registered office has jurisdiction. Based on your request, the application can also be submitted to the conciliation body indicated in your request instead of the competent conciliation body mentioned above. Our company is obliged to cooperate in the conciliation procedure.

If neither the law nor these General Terms and Conditions (GTC) require written communication on paper between mYields and the user, the parties accept email messages as written communication.
17. Others

The parties are exempt from liability for the partial or total failure to fulfill their obligations under these Terms and Conditions if it is caused by force majeure. Force majeure refers to circumstances that were unforeseeable at the time of the contract and fall under the collective term of unavoidable events beyond the parties' control, such as war or revolution, strike, quarantine restrictions, natural disaster, flood, earthquake, lightning strike, fire, storm, war, epidemic, other natural disaster, subsequent legislative changes, and any other circumstances beyond the reasonable control of the parties. If such an event occurs, the party becoming aware of it must notify the other party. All damages and costs resulting from the failure to notify or delayed notification shall be borne by the party in delay.

The governing law for these Terms and Conditions is Hungarian law. In particular, the provisions of Act CVIII of 2001 on certain issues of electronic commerce services and information society services ('Ektv.'), Government Decree 45/2014 (II. 26.) on the detailed rules of contracts between consumers and businesses, and Act V of 2013 on the Civil Code shall apply to purchases made on the mYdentification Website. The Hungarian courts have exclusive jurisdiction to resolve any disputes arising from these Terms and Conditions.

If any provision of these Terms and Conditions is or becomes invalid, it does not affect the validity of the other provisions of these Terms and Conditions.

The provisions of these Terms and Conditions constitute the entire agreement between you and mYields, and supersede all prior agreements and understandings related to the subject matter of these Terms and Conditions. The parties may only deviate from the provisions of these Terms and Conditions by a separate written agreement.

mYields is not responsible for any damages if an order is not received due to any operational error, nor is it responsible for any malfunction resulting from hardware or software errors of the user's computer, or for damages caused by internet connection interruptions.

If any content on the mYdentification Website does not comply with the provisions of these Terms and Conditions, the latter shall prevail, unless otherwise regulated by law.

The Products and services available from the mYdentification Website are provided 'as is' and 'as available'. mYields takes all reasonable and expected measures to ensure the safe operation of the mYdentification Website, but assumes no responsibility for any damages arising from the existence, use, inability to use, improper operation, malfunction, suspension (whether with or without prior notice), or complete shutdown of the mYdentification Website, or from the deletion of content accessible from the mYdentification Website. This also includes damages resulting from line or system errors, potential computer viruses carried by the website, or unauthorized alteration of data by anyone. Information of warranty or supplies, product warranty, and guarantee
1. Supplier's Warranty
In what cases can you exercise your warranty rights?
In the event of defective performance by mYields Kft. you can assert a warranty claim against the company in accordance with the rules of the Civil Code.
What rights do you have based on your warranty claim?
You can choose from the following warranty claims:
You can request a repair or replacement, unless the fulfillment of the chosen claim is impossible or would result in disproportionate additional costs for the company compared to fulfilling another claim.
If you did not request or could not request a repair or replacement, you can demand a proportional reduction of the consideration or repair he defect t the company's expense, or have it repaired by someone else , or -as a last resort- withdraw from the contract.
In a contract between consumer and a business for the sale of goods classified s movable property, the provision of digital content , or the provision of digital services , you cannot repair the defect yourself or have it repaired by someone else at the company's expense as part of exercising your warranty rights.
What's the deadline for asserting your warranty claim?
You must report the defect immediately after discovering it, but no later than two months from the discovery of the defect. However, lease note that you cannot assert your warranty rights beyond the two-year limitation period rom the fulfillment of the contract.
Against whom can you assert your warranty claim?
You can assert your warranty claim against the company.
What other conditions are there for asserting your warranty rights?
Within one year from the fulfillment, there are no other conditions for asserting your warranty claim beyond reporting the defect, provided you can prove that the product or service was provided by mYields Ltd. However, after one year from the fulfillment, you must prove that the defect you identified already existed at the time of fulfillment.
2. Product Warranty
In what cases can you exercise your product warranty rights?
In the event of a defect in a movable item (product), you can choose to assert either your right specified in point 1 or a product warranty claim.
What rights do you have based on your product warranty claim?
As a product warranty claim, you can only request the repair or replacement of the defective product.
When is a product considered defective?
A product is considered defective if it does not meet the quality requirements in force at the time of its marketing or if it does not have the properties described by the manufacturer.
What is the deadline for asserting your product warranty claim?
You can assert your product warranty claim within two years from the date the product was placed on the market by the manufacturer. After this period, you will lose this right.
Against whom and under what other conditions can you assert your product warranty claim?
You can only exercise your product warranty claim against the manufacturer or distributor of the movable item. In the case of asserting a product warranty claim, you must prove the defect of the product.
In what cases is the manufacturer (distributor) exempt from product warranty obligations? The manufacturer (distributor) is only exempt from product warranty obligations if they can prove that:

The product was not manufactured or marketed in the course of their business activity, or

The defect was not detectable according to the state of science and technology at the time of marketing, or
-
The defect is due to the application of a law or mandatory regulatory requirement.
The manufacturer (distributor) only needs to prove one of these reasons to be exempt.
Please note that you cannot assert a warranty for supplies and a product warranty claim simultaneously or in parallel for the same defect. However, if you successfully assert a product warranty claim, you can assert your warranty for supplies claim against the manufacturer for the replaced product or repaired part.
3. Guarantee
In what cases can you exercise your guarantee rights?
In the event of defective performance, mYields Ltd. is obliged to provide a guarantee based on the contract.
What rights do you have and within what timeframe based on the guarantee?
mYields Ltd. guarantees that the ordered product will meet the technical functions specified in point 4 of the General Terms and Conditions (GTC) and on the mYdentification Website for 1 year from the date of delivery to the customer. mYields Ltd.'s guarantee obligation is limited to the correction of deviations from these technical functions (i.e., malfunction or non-functioning of the chip or QR code on the business card). mYields Ltd. will correct these defects free of charge for the customer during the warranty period, based on a written defect notification sent by the customer to mYields Ltd.
mYields Ltd. will carry out the defect correction considering the following:
mYields Ltd. is obliged to correct the defect, at its discretion, either by replacement, providing support, or making modifications necessary to ensure proper operation. In the event of a defect occurring during the warranty period, mYields Ltd. will respond in writing to the written notification received from the customer and indicate the expected duration of the defect correction.
mYields Ltd. will correct defects reported during the warranty period even after the warranty period has expired. For the replaced (repaired) part and for defects resulting from the correction, the warranty period will restart.
The fulfillment of mYields Ltd.'s guarantee obligations is conditional upon the customer's compliance with the following provisions:
The customer must use the plastic cards provided by mYields Ltd. as intended. The customer is obliged to report the malfunction to mYields Ltd. in writing without delay. The time of the malfunction is considered to be the time of the defect report.
The guarantee does not cover any defect, malfunction, or damage caused by any modification, alteration, or repair carried out by the customer that has not been previously approved in writing by mYields Ltd.
When is the company exempt from its guarantee obligations?
The business is only exempt from its warranty obligation if it proves that the cause of the defect occurred after the performance.
Please note that you cannot enforce a warranty claim and a product warranty claim, or a warranty claim and a product liability claim simultaneously for the same defect. However, your rights arising from the warranty are independent of the entitlements specified in points 1 and 2.
